By accepting a position on the Board that David Ray Pierce knows he has not been duly elected to hold, he is engaging in deceitful behavior and undermining the democratic process. It seems unethical for a licensed attorney to engage in this kind of chicanery. Integrity, honesty, and fairness are crucial in any election process.
A joke by Homeowner X about a homeowner association vice president who was elected through manipulation of the electoral process:
Take my HOA vice president, for example. He was 'elected' by the board stuffing the ballot box with their own votes, denying many members the ability to vote, and by having their management company count the votes. They were so proud of themselves! They tell people, "We won by a landslide!"
But when asked how many votes any of them got, they say, "Some."
"Some?" Homeowner X asks. "There are 94 homeowners in this community. Some is not a number."
"Yeah," the vice president said. "But I'm vice president now, anyway."
In the tranquil El Mirador subdivision of Santa Teresa, New Mexico, a sinister plot is unfolding. David Ray Pierce, an El Paso attorney with dubious motives managed to secure a position on the El Mirador Homeowners Association Board of Directors. The election process was marred by manipulation and deceit, orchestrated by incumbent Board members who welcomed Pierce into their fold.
His wife, Judith Pierce, is complicit in his scheme. Together they have cultivated an atmosphere of resentment and hostility within the small community against their neighbors for years. The Pierce's seem to thrive on creating discord and tension. For example, the Pierce's and their visitors parked in their neighbors driveway hundreds of times, and dumped a considerable amount of construction waste onto the neighboring property.
After a year, the Pierce's were asked to stop parking there, and to clean up the material dumped by their workers, they began a campaign of harassment and oppression that still exists today. They have subsequently obstructed their neighbor's driveway; made every effort to disseminate negative sentiment against the neighbors throughout the community; conspired with the Association's Board and Design Review Committee to deny their neighbors a fair design review; shined a powerful spotlight into the neighbor's bedroom windows at night; etc. The capacity for outrageous behavior by the Pierce's seems unlimited.
With David’s ill-gotten position on the Board, their reign of terror has already intensified through the newly 'hired' management company, DANA Properties. The residents of El Mirador should brace themselves for an escalation in the harassment campaign that David and Judi had been waging for years. Pierce's neighbor began gathering evidence of their campaign of hostility, some of which can be found below and in other pages of this website.
